WITHOUT REGARD TO THE CHOICE OF LAW PRINCIPLES THEREOF. THE UNITED NATIONS CONVENTION ON CONTRACTS FOR THE INTERNATIONAL SALE OF GOODS SHALL NOT APPLY TO THIS AGREEMENT. ANY ACTION SEEKING LEGAL OR EQUITABLE RELIEF ARISING OUT OF OR RELATING TO THESE TERMS OR MANUAL WILL BE BROUGHT ONLY IN THE COURTS OF THE UNITED ARAB EMIRATES.

By contacting this website of DialZilla and validating project order with us, you admit your approval of all the below mentioned World Atlantus international FZC Terms and Conditions.

Payment:

• Client is responsible to pay 50% advance before starting of designing and development process and we will take remaining 50% payments at the end of project, before handing over to the client.

• Advance of 50% will be nonrefundable.

• All payments of SEO Services will be in advance also.

• Outsourced project payment will be after 100% project completion.

Prototype:

• We will not show any project prototype before advance payment. We provide two prototypes, but by default we show one prototype and involve the client.

• In case of special offer, if mentioned in proposal, we show multiple prototypes.

• We provide user intensive products and involve users.

Designing and Development:

• In designing phase, client must finalize the website outlook within first week.

• We provide 6 months website maintenance services for existing feature updates.

• After 6 months we will charge website maintenance cost.

Domain and Hosting:

• We provide third party web hosting services. In case of hosting down time, DialZilla will not responsible because we are resellers.

• Domain name will registered after 50% down payment.

• Client will be responsible to pay the outstanding amount one month before expiry of domain and hosting.

• Obstruction in website data and email will be cause of hosting expiration.

Search Engine Optimization:

• We charge SEO services on monthly basis, and all the payment will be in advance.

• If client needs any SEO campaign, PPC, CPC, AdSense etc, than he/she will bear all the campaign charges. DialZilla will get service charges separately.

• A client having website developed by any other company, which contain significant errors, is the responsibility of client.

• We include blogs and article writing services in our SEO packages, but contents for website pages will be charged separately.

• If a client havening website which had SEO process before taking DialZilla SEO services and contains spam links, then our SEO team is not responsible for its ranking results.

• Finalize the selected number of keywords in proposal according to the packages we offer. Additional keyword will entail addition contract or charges.

• We offer 3 months to 6 months services for good ranking results. Extend of services time period depends on website owner.

• During our SEO services, we will bear any change of search engine algorithm. After the end of services, if any new algorithm updates effects on client website, DialZilla will not be responsible for it.Life is conversational. Web design should be the same way

Privacy

The parties (The Client and DialZilla) agree that they will handle all personal Information shared with each other will be used for the purpose of carrying out their respective obligations pursuant to this Contract. Subject to Clause the Parties may only disclose any Confidential Information where disclosure is required by law or by any legal notice. We are committed to protecting your privacy and take our responsibilities regarding the security of personal information very seriously.

Policies

All policies, rules and regulations are the final decision of DialZilla Software House.com. We reserve the right to modify, add or change any policies as we deem necessary at any time. All members agree that they will not hold DialZilla Software House.com liable for any items or policies within this program.

Partly Refund

We at DialZilla Software House.com strive to keep our customer happy with their every purchase. If you are, for any reason, not entirely happy with your purchase for particular service, we will cheerfully issue a partly refund for a particular service. Refund issued only till the drafting of Website or software initial Phases, once SRS or Draft design approved or Launching of website is made we not Refund any money

Eg. Customer paid Hosting+ Domain Fee then paid us for Website Design, We create a draft design or SRS Document with few designs. On this stage cancellation means you will only get 70% refund of Except the Hosting and Domain fees.

Refunds

Refund policy includes a refund of the initial amount if the client is not satisfied with the prototype which is demonstrated before we actually publish the design to HTML and start any programming. We demonstrate our work using one of our links so you can review everything before making complete payment and asking us to deliver the website on our server or any 3rd party hosting. Once you make the complete payment, the same copy of website would be delivered. The refund cannot be claimed after the website has been delivered to you. A website will be considered to be delivered if it has been posted on your desired hosting, our hosting, sent to you as a downloadable link or given to you in any storage media like Flash Drive, Zip drive, CD etc. All domain and registration fees are non-refundable, in whole or in part, even if your domain name registration is suspended, cancelled or transferred prior to the end of your then current registration term.

Acceptance of Agreement

You agree to the terms and conditions outlined in this Terms of Use Agreement (“Agreement”) with respect to our site (the “Site”). This Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement.
